In this privacy notice, we describe our privacy policy. We seek to explain to you in the clearest way possible what information we collect, how we use it and what rights you have in relation to it.

This privacy policy applies to all information collected through our website (such as https://www.livecontrol.io), and/or any related services, sales, marketing or events (we refer to them collectively in this privacy policy as the "Sites").

Remember that your use of LiveControl's Services is at all times subject to our Terms of Service, which incorporates this Privacy Policy. Any terms we use in this Policy without defining them have the definitions given to them in the Terms of Service.

What this Privacy Policy Covers

This Privacy Policy covers how we treat Personal Data that we gather when you access or use our Services. "Personal Data" means any information that identifies or relates to a particular individual and also includes information referred to as "personally identifiable information" or "personal information" under applicable data privacy laws, rules or regulations. This Privacy Policy does not cover the practices of companies we don't own or control or people we don't manage.

Examples: Industry identifiers (e.g. religion, music, education etc.)

Payment Data

Examples: Payment card type, last 4 digits of payment card, billing address, phone number, and email

Shared with: Service Providers (specifically our payment processing partner, currently Stripe, Inc.)

Device/IP Data

Examples: IP address, type of device/operating system/browser used to access the Services

Shared with: Service Providers, Analytics Partners, Advertising Partners

Web Analytics

Examples: Web page interactions, referring webpage/source, statistics associated with the interaction between device or browser and the Services

Shared with: Advertising Partners, Analytics Partners, Service Providers

Registration Data

Examples: Viewer first and last name, viewer email

Shared with: Client in which the event is registered

Categories of Sources of Personal Data

We collect Personal Data about you from the following categories of sources:

You — When you provide such information directly to us (creating an account, using our interactive tools and Services, sending us an email) and when you use the Services and such information is collected automatically (through Cookies, location-enabled browsers, and certain applications).

Third Parties — Vendors (analytics providers, lead generation), Advertising Partners, and Social Networks.

Our Commercial or Business Purposes for Collecting Personal Data

Providing, Customizing and Improving the Services — Creating and managing your account, processing orders, providing support, improving the Services, personalizing content, fraud protection, and carrying out other business purposes as set forth in applicable data privacy laws.

Marketing the Services — Marketing and selling the Services, showing you advertisements including interest-based advertising.

Corresponding with You — Responding to correspondence, contacting you when necessary, and sending communications according to your preferences.

Meeting Legal Requirements and Enforcing Legal Terms — Fulfilling legal obligations, protecting rights, enforcing agreements, and resolving disputes.

How We Share Your Personal Data

We disclose your Personal Data to the categories of service providers and other parties listed in this section.

Service Providers — Hosting, technology and communication providers; security and fraud prevention consultants; support and customer service vendors; product fulfillment providers; payment processors (our payment processing partner Stripe, Inc. collects your voluntarily-provided payment card information).

Analytics Partners — Companies that track how users found or were referred to the Services and how users interact with the Services.

Business Partners — Businesses that you have a relationship with and companies that we partner with for joint promotional offers.

Parties You Authorize, Access or Authenticate — Third parties you access through the services and social media services.

Tracking Tools, Advertising and Opt-Out

The Services use cookies and similar technologies such as pixel tags, web beacons, clear GIFs and JavaScript (collectively, "Cookies") to enable our servers to recognize your web browser, tell us how and when you visit and use our Services, analyze trends, learn about our user base and operate and improve our Services.

Data Security and Retention

We retain Personal Data about you for as long as you have an open account with us or as otherwise necessary to provide you with our Services. In some cases we retain Personal Data for longer, if doing so is necessary to comply with our legal obligations, resolve disputes or collect fees owed.

Registration and Data Collection

This section explains how LiveControl collects, uses, and safeguards your personal information in relation to the registration process and data collection when using our live web player platform (the "Platform").

Information We Collect: When you choose to register to access certain live or past events on the Platform, we may collect your first name, last name, and email address.

Use of Your Information: The registration information collected will be used by LiveControl and our Clients to manage your access to registered events, personalize your viewing experience, and deliver event-related communications. Clients may also use your registration information for marketing purposes.

Data Sharing: LiveControl Clients who are hosting the registered events will have access to the registration data for the purposes of managing event access and communication. By registering for an event, you acknowledge and agree that your registration information will be provided to the respective Client hosting the event.

What are your privacy rights?

You may review, change, or terminate your account at any time. If you would at any time like to review or change the information in your account or terminate your account, you can contact us at hello@livecontrol.io.

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with legal requirements.

Opting out of email marketing: You can unsubscribe from our marketing email list at any time by clicking on the unsubscribe link in the emails that we send or by contacting us at hello@livecontrol.io.

Personal Data of Children

As noted in the Terms of Service, we do not knowingly collect or solicit Personal Data about children under 13 years of age; if you are a child under the age of 13, please do not attempt to register for or otherwise use the Services or send us any Personal Data. If we learn we have collected Personal Data from a child under 13 years of age, we will delete that information as quickly as possible. If you believe that a child under 13 years of age may have provided Personal Data to us, please contact us at hello@livecontrol.io.

California Resident Rights

If you are a California resident, you have the rights set forth in this section.

Access: You have the right to request certain information about our collection and use of your Personal Data over the past 12 months, including the categories of Personal Data collected, the sources, the business purpose for collecting, the categories of third parties with whom we have shared your Personal Data, and the specific pieces of Personal Data collected.

Deletion: You have the right to request that we delete the Personal Data that we have collected about you. Under the CCPA, this right is subject to certain exceptions.

Personal Data Sales Opt-Out: We will not sell your Personal Data, and have not done so over the last 12 months.

Other State Law Privacy Rights

California Resident Rights: Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to contact us to prevent disclosure of Personal Data to third parties for such third parties' direct marketing purposes. Nevada Resident Rights: If you are a resident of Nevada, you have the right to opt-out of the sale of certain Personal Data to third parties. You can exercise this right by contacting us at hello@livecontrol.io with the subject line "Nevada Do Not Sell Request." However, LiveControl does not engage in the sale of Personal Data.

Changes to this Privacy Policy

We're constantly trying to improve our Services, so we may need to change this Privacy Policy from time to time, but we will alert you to any such changes by placing a notice on the LiveControl website, by sending you an email and/or by some other means. If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all of the changes.
